Instructor Bio

Shaun Santos,Attorney
Sgt. Santos has been a law enforcement officer for 20 years, with over 15 years experience as a Narcotics Detective. He has extensive experience working with the Drug Enforcement Administration conducting electronic surveillance investigations in to the Drug Trafficking Organizations. Shaun is currently assigned to the DEA’s Financial Investigations Team (FIT), anti-money laundering group, responsible for conducting large international money laundering investigations. He has experience with foreign and domestic money pick-ups, international bank wire transfers, familiarity with Black Market Peso Exchange, and Attorney General Exempt Operations (AGEO), allowing for the laundering of drug proceeds in furtherance of narcotics investigations. Shaun has received his Bachelor Degree in Criminal Justice, University of Massachusetts, Lowell, MA; Masters Degree from Anna Maria College; and Juris Doctorate from Suffolk University Law School.

PATC is proud to present this dynamic two-day class, which addresses the legal issues facing law enforcement officers today.

The changing world means vast changes in the way law enforcement officers conduct themselves. Technological advances such as body cameras, drones and civilian use of cell phones to video officers in action are driving a new body of case and statutory law. Consider:

  • Social networking has implications in the conduct of criminal investigations; it likewise has been the subject of internal investigations when officers post questionable content.
  • As companies market drones to law enforcement to use in accident and criminal investigations, natural disaster relief, search and rescue missions and large public gatherings and demonstrations, law enforcement leaders must be aware of the legal restrictions that apply to drone use.
  • Recordings from citizens’ mobile phones, dash cams and the news media are commonplace, increasing scrutiny of officers’ conduct while making arrests, confronting armed suspects and executing search warrants. These recordings are increasingly being used against officers in criminal and civil litigation. As a result, the courts are scrutinizing officer conduct and are rejecting qualified immunity defenses; this trend has brought about an increase in the filing of criminal charges and civil settlements, some totaling in the millions of dollars.
  • Revelations that the use of Tasers may cause heart attacks or other severe injuries has caught the attention of many courts and law officers use of the devices is being highly analyzed.

These technological and legal trends have put law enforcement officers under the microscope. Even officers who are acting upon their training and in a manner consistent with agency policies and procedures are being sanctioned.

To stay on the right side of the law, officers and their agencies must be aware of legal trends and update their standard operating procedures and policies to reflect the courts’ recent rulings. This course will cover these trends as well as the legal aspects of friendly fire shootings; the use of body cameras by confidential informants; interrogation of a suspect who has been subjected to a Taser; guidelines for developing policies; and more tips and tidbits for officers.

The instruction includes the use of video, often the actual recording of the event that brought about litigation, to promote discussion and increase class attendees’ understanding of courts’ reasoning and holdings.
